By way of example, as partner at his prior firm, Conner led a team to a historic complete defense victory in an 11-patent case filed by a subsidiary of Taiwanese heavyweight Foxconn in Delaware federal district court that threatened astronomical damages against his client.
Conner drafted a successful motion to stop the litigation to allow his team’s inter partes review (“IPR”) challenges of the validity of certain patents to proceed first at the Patent and Trademark Office. Working with co-counsel, Conner’s team knocked out six patents through IPR proceedings.
Conner’s team later knocked out three of the five remaining patents in the district court litigation through license and failure to mark defenses. Conner successfully argued the failure to mark issue at a pre-trial hearing days before trial was scheduled to begin. Conner’s team also coordinated with co-counsel who led efforts to knock out the remaining two patents through noninfringement defenses.
The plaintiffs appealed four separate issues, and the U.S. Court of Appeals for the Federal Circuit affirmed Conner’s team’s resounding victory on all four issues appealed.
